Terms of Service & User Liability Agreement

INDEPENDENT STUDENT COMMUNITY · ZERO OFFICIAL INSTITUTIONAL AFFILIATION

The KIMS Student Community (“Platform”) is an independent, non-commercial peer network created and maintained voluntarily by students. It is NOT affiliated with, operated by, endorsed by, or in any way officially connected with the Kempegowda Institute of Medical Sciences (KIMS), the Rajya Vokkaligara Sangha (RVS), or Rajiv Gandhi University of Health Sciences (RGUHS).No statements, circulars, or discussions on this site constitute official institutional notices.

01Acceptance of Terms & Eligibility

By accessing, browsing, registering on, or using this platform, you agree to be bound by these Terms of Service, our Privacy Policy, and our Community Guidelines. If you do not agree to these terms, you must immediately discontinue use of this platform. This platform is strictly intended for peer connection and academic communication among enrolled medical students.

02Sole User Responsibility & Complete Indemnity

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ANY CONTENT, COMMENTS, MEDIA, FORUM POSTS, MARKETPLACE LISTINGS, TRANSACTIONS, OR COMMUNICATIONS YOU PUBLISH OR CONDUCT ON THIS PLATFORM.

  • Primary Publisher Status: Under Indian civil, criminal, and IT laws, you are recognized as the sole originator and author of your content.
  • Full Indemnification: You agree to fully indemnify, defend, and hold harmless the platform creator, student maintainers, and site administrators against any and all claims, liabilities, damages, losses, expenses, legal costs, show-cause notices, or institutional disciplinary investigations arising out of or related to your breach of these terms, your posted content, or your violation of any law or rights of a third party.
  • No Liability for Student Maintainers: The student developers and administrators act strictly as technical providers of an interactive intermediary platform and disclaim all liability for any defamatory, offensive, tortious, or illegal conduct of any user.

03Intermediary Safe-Harbour (Section 79, IT Act 2000 & IT Rules 2021)

This platform operates as an electronic intermediary in terms of Section 2(1)(w) and claims safe-harbour immunity under Section 79 of the Information Technology Act, 2000. In accordance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, users are strictly prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, or sharing any information that:

  • Belongs to another person and to which the user does not have any right;
  • Is defamatory, obscene, invasive of another’s bodily privacy, insulting, or harassing on the basis of gender or ethnicity;
  • Involves any act of ragging, hazing, intimidation, or bullying of any junior or peer student;
  • Infringes any patent, trademark, copyright, or proprietary rights;
  • Impersonates any college authority, professor, doctor, or fellow student;
  • Contains software viruses or malicious computational payloads;
  • Is patently false, untrue, or defamatory against faculty or fellow students.

04Strict Prohibitions: Medical Ethics & Regulated Items

As a platform serving medical students, the following are strictly prohibited and will result in instant account termination and referral to appropriate authorities:

  • Patient Confidentiality / NMC Violations: Under NMC regulations and medical ethics, posting patient records, identifiable patient photographs, clinical history sheets, or unauthorized hospital ward recordings is strictly forbidden.
  • Prescription & Pharmaceutical Items: The sale, barter, or transfer of prescription medications, injectables, controlled substances, or clinical drug samples is an offense under the Drugs and Cosmetics Act, 1940 and is totally barred.
  • Examination Leaks: Distribution of confidential question papers, proxy attendance schemes, or academic malpractice material is prohibited.

05Peer Classifieds & Handover Rules

The marketplace is a localized peer-to-peer directory for second-hand textbooks, medical instruments (e.g. stethoscopes, bone sets), and hostel essentials. All transactions, payments (cash or UPI), and inspections are conducted strictly and directly between student buyer and seller in person on campus. The platform charges zero commission, holds no funds in escrow, and assumes zero liability for item condition, authenticity, or disputes.

06Account Suspension & Content Moderation

The student administrators reserve the right, at their sole discretion, to remove any post, listing, or comment, and to suspend or permanently ban any user account that violates these terms, without prior notice.

07Grievances & Takedowns

If you believe any content on this site infringes your rights, defames you, or violates the law, please visit our Grievance Redressal portal. All legitimate takedown notices are processed within the statutory 24–36 hour timeframe.
